William Lindemann, 47, who served prison time a decade ago for medical fraud, pleaded not guilty to manslaughter and assault charges last week in Stamford Superior Court. He is accused of striking 79-year-old Herbert Davison on Jan. 27.
Prosecutors decided to add the manslaughter charge after Davison died Sunday, two days after Lindemann was arrested at his home in Naples, Fla. Davison declined to comment after the brief court hearing. He was released after posting a $1 million bond.
A witness told police he spotted the two men arguing in the parking garage. Police said Davison, who the witness said appeared to be intoxicated, was headed to a nearby restaurant for a weekly poetry event. “Get out of here!” Lindemann yelled at Davison, according to the affidavit.
Davison shouted something back at Lindemann, who then punched the older man in the face, the affidavit says. The witness said Davison fell hard and struck his head on the pavement.
Davison was bleeding from the mouth and nose when the witness, who was not named in the court paper, told Lindemann they should call an ambulance, the document says.
“Oh, he’s fine!” Lindemann said, according to the affidavit.
Lindemann then gathered papers that fell from Davison’s pockets and returned them, the witness said. The witness turned his attention to Davison, and when he looked up again, Lindemann was gone, the affidavit says.
