More than two years after killing 78-year-old city resident Herbert Davison with a punch in a downtown parking lot, a 49-year-old Florida man was found guilty of criminally negligent homicide Monday by a jury of six.
As Davison's three sons and wife, Rhea, looked on, William Lindemann, 49, a former chiropractor of Naples, Fla., was also found not guilty of the more serious charges he faced in the altercation: first-degree manslaughter, first-degree assault of a person over age 60, and second-degree manslaughter.
Criminally negligent homicide, which is a class A misdemeanor, carries a jail sentence of up to one year in prison, three years of probation, and a $1,000 fine, under state law.
After Judge Gary White set a sentencing date of Aug. 10 and adjourned the court, Bruce Davison, the 49-year-old son of Herbert Davison, addressed Lindemann from the rear of the courtroom.
"I'll never forget you killed my father, Mister Lindemann!" Bruce Davison shouted at the defendant after the verdict was read.
As marshals approached Davison, he added in a sarcastic tone, "Doctor!"
Shortly after the verdict was read, Lindemann emerged in tears from a conference room outside the fourth-floor courtroom where he had been conferring with his attorneys Richard Meehan and Edward Gavin.
Lindemann declined comment.
Meehan said Lindemann's heart went out to the Davison family, but that the jury was correct to find his client innocent of the more serious charges.
"This jury was an extremely well-educated jury to begin with ..." Meehan said. "... We would have liked to have heard that third not guilty, but are extremely thankful they did not find my client's action showed reckless disregard."
